Upon termination of your account, your right to use the services, access the sites, and any content will immediately cease.

Security and User Registration
As a condition to using our services, you may be required to register with us and select a password and username. We do not have your password.
During registration, you shall provide us with accurate, complete, and updated registration information. Failure to do so shall constitute a breach of this agreement, which may result in immediate termination of your account.
You may not select or use as an Authorized Advertiser User ID name of another person with the intent to impersonate that person or use as an Authorized Advertiser user ID a name subject to any rights of a person other than you without appropriate authorization.
We reserve the right to refuse registration of or cancel an Authorized Advertiser User ID at our sole discretion. You are responsible for maintaining the confidentiality of your password.
Fees and Payments
We reserve the right to require payment of fees for some or all of our services.
You shall pay all applicable fees, as described in our agreement in connection with such services selected by you.
THE POSTING BOARD reserves the right to change its price list and to institute new charges at any time, upon thirty (30) days prior notice to you, which may be sent by email.
Use of our services by you following such notification constitutes your acceptance of any new or increased charges. Payments may be made via ACH or credit card. All credit card payments will incur a $3.00 - $7.00 monthly administration fee. All returned checks will incur a $35 return check fee.
Legal Compliance
You assume all knowledge of applicable law and you are responsible for compliance with any such laws. You may not use our websites in any way that violates applicable state, federal, or international laws, regulations, or other government requirements.
Legal Jurisdiction or Venue
Our websites are operated and provided in the State of Florida.
As such, we are subject to the laws of Florida, and such laws will govern these Terms of Service, without giving effect to any choice of law rules.
Accordingly, when you choose to access our websites you agree to do so subject to the laws of Florida.
The state and federal courts of Florida shall serve as the venue for any actions brought, or claims made, arising out of your use of our sites.
Typographical errors
When a product or service is listed with incorrect information due to any typographical error or incorrect information received from you as an Authorized Advertiser, ThePostingBoard.com shall have the right to refuse or cancel your advertisement. We shall have the right to refuse or cancel any such advertising whether or not your payment has been made for services.
Use of ThePostingBoard.com disclaimer and limitation of liability
EXCEPT AS OTHERWISE OUTLINED IN OUR TERMS OF SERVICE AGREEMENT AND POLICY AGREEMENT AND OUR SUPPORT INFORMATION THAT GOVERNS SERVICE ON THIS SITE, THE PRODUCTS/SERVICES OFFERED AND THE TRANSACTIONS CONDUCTED THROUGH IT ARE PROVIDED BY US ON AN "AS IS" BASIS. ThePostingBoard.com/The Posting Board shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond THE POSTING BOARD reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation (including "line-noise" interference). when any provision of this agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this agreement shall otherwise remain in full force and effect and enforceable.
This agreement is not assignable, transferable, or sub-licensable by you except with our prior written consent.
ThePostingBoard.com may transfer, assign, or delegate this Agreement and its rights and obligations without consent.
This agreement shall be governed by and construed under the laws of the state of Florida without regard to the conflict of law’s provisions thereof.
Any dispute arising from or relating to the subject matter of this agreement shall be finally settled by arbitration in Palm Beach County, Florida, using the English language in accordance with the Arbitration Rules and Procedures of Judicial Arbitration and Mediation Services, Inc. ("JAMS") then in effect, by one commercial arbitrator with substantial experience in resolving intellectual property and commercial contract disputes, who shall be selected from the appropriate list of JAMS arbitrators per the Arbitration Rules and Procedures of JAMS.
The arbitrator shall be selected by the joint agreement of the parties. In the event the parties cannot agree on an arbitrator within thirty (30) days of the initiating party providing the other party with written notice that it plans to seek arbitration, the parties shall each select an arbitrator affiliated with JAMS, which arbitrators shall jointly select a third such arbitrator to resolve the dispute.
The written decision of the arbitrator shall be final and binding on the parties.
Judgment upon the award so rendered may be entered in a court having jurisdiction or application may be made to such court for judicial acceptance of any award and an order of enforcement, as the case may be.
Notwithstanding the foregoing, each party shall have the right to institute an action in a court of proper jurisdiction for injunctive or other equitable relief pending a final decision by the arbitrator.
For all purposes of this Agreement, the parties' consent to exclusive jurisdiction and venue in the United States Federal Courts. Both parties agree that this agreement is the complete and exclusive statement of the mutual understanding of the parties and supersedes and cancels all previous written and oral agreements, communications and other understandings relating to the subject matter of this agreement and that all modifications must be in a writing signed by both parties, except as otherwise provided herein.
No agency, partnership, joint venture, or employment is created as a result of this agreement and you do not have any authority of any kind to bind ThePostingBoard.com/The Posting Board in any respect whatsoever.
In any action or proceeding to enforce rights under the Terms of Service, the prevailing party will be entitled to recover costs and attorneys' fees.
Both parties agree that the Terms of Service is the complete and exclusive statement of the mutual understanding of the parties and supersedes and cancels all previous written and oral agreements, communications and other understandings relating to the subject matter of the Terms of Service and that all modifications must be in a writing signed by both parties, except as otherwise provided herein.
